1. Agreement to Terms
By accessing and using the TrackUA website and services, you accept and agree to be bound by and comply with these Terms of Service. If you do not agree, please do not use this service. Your continued use of the service following any updates to these terms constitutes acceptance of those changes.
2. Use License
Permission is granted to access and use TrackUA for your organisation's internal workforce monitoring purposes in accordance with your active subscription plan. Under this license you may not modify, copy, or redistribute any part of the platform or its underlying software; use the service for any unlicensed commercial purpose or public display; attempt to decompile, reverse engineer, or extract source code from any software component; remove or obscure any proprietary or copyright notices; or transfer your license or access credentials to another organisation without our written consent.
TrackUA reserves the right to terminate this license immediately if any of these conditions are violated.
3. User Accounts
When you create an account with TrackUA, you are solely responsible for maintaining the confidentiality of your login credentials, all activities that occur under your account regardless of whether you authorised them, notifying us promptly at support@trackua.com if you suspect any unauthorised use, and ensuring all registration information is accurate, current, and complete at all times. We reserve the right to suspend or terminate accounts where information is found to be false or misleading.
4. Prohibited Activities
You agree not to use TrackUA for any purpose that violates applicable local, national, or international law or regulation. Prohibited conduct includes, but is not limited to, using the service to harass, threaten, or harm any individual; attempting to gain unauthorised access to our systems, servers, or databases; submitting false, misleading, or fraudulent information; transmitting viruses, malware, or any other harmful code; and interfering with or disrupting the integrity or performance of the service. Violation of these terms may result in immediate account termination and, where appropriate, referral to law enforcement.
5. Disclaimer
The TrackUA service is provided on an "as is" and "as available" basis without warranties of any kind, either expressed or implied. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components, nor that any defects will be corrected.
6. Limitations of Liability
To the fullest extent permitted by applicable law, TrackUA and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or business interruption — arising out of or in connection with your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total liability to you for any direct damages shall not exceed the fees paid by you to TrackUA in the twelve months immediately preceding the claim.
7. Modifications
TrackUA reserves the right to revise these Terms of Service at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or in-app notice. Your continued use of the service after any revision constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which TrackUA operates. You irrevocably submit to the exclusive jurisdiction of the courts in that location for the resolution of any disputes arising out of or relating to these terms or your use of the service. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
